These Terms and Conditions ("Terms") govern your access to and use of mydiabetesinsight.com, related online features, and the diabetes education classes, workshops, appointments, and other services offered by Diabetes Insight, LLC (collectively, the "Services"). "Diabetes Insight," "we," "us," and "our" refer to Diabetes Insight, LLC.
By using the website or registering for, purchasing, or participating in a Service, you agree to these Terms. If you do not agree, do not use the website or purchase or participate in the Services. Additional terms presented during booking, payment, or registration are incorporated into these Terms.
1. Description of Services
Diabetes Insight is a Florida-based provider of diabetes self-management education and related educational support for adults with type 2 diabetes or prediabetes, caregivers, healthcare providers, and healthcare facilities. Services may include:
Group diabetes education workshops offered in person or virtually.
One-on-one diabetes education sessions offered virtually, in person, or through an approved location or arrangement.
Continuous glucose monitoring (CGM) technology education.
Educational services provided for physicians’ offices, clinics, hospitals, and other healthcare facilities.
Related educational materials, follow-up communications, and support resources.
Service descriptions, schedules, instructors, delivery methods, locations, prices, and availability may change. We do not guarantee that every Service will be available at all times.
2. Educational Services; No Substitute for Medical Care
2.1 Educational Purpose
The website and Services provide diabetes education and general health information. They are not a substitute for examination, diagnosis, treatment, medication management, nutrition therapy, or other individualized medical care from your physician or another qualified treating healthcare professional.
2.2 Role of Our Educators
Our educators may be registered nurses and Certified Diabetes Care and Education Specialists. They provide education within the scope of the applicable Service and their professional qualifications. Participation does not establish a physician-patient relationship and does not make Diabetes Insight your primary or treating medical provider.
2.3 Consult Your Treating Provider
Do not start, stop, or change medication, insulin, diet, exercise, glucose-monitoring practices, or another treatment plan solely because of information obtained through the website or Services. Discuss individualized decisions with your treating healthcare professional.
2.4 Emergencies
Diabetes Insight does not provide emergency medical services. Call 911 or go to the nearest emergency department if you believe you are experiencing a medical emergency. Do not use the website, email, text messaging, voicemail, a class, or the appointment portal to request emergency assistance.
2.5 No Guarantee of Results
Health outcomes vary by individual and depend on factors outside our control. We do not promise or guarantee specific glucose levels, weight changes, medication changes, health improvements, or other outcomes from participation in the Services.
3. Eligibility and Registration
3.1 Adult Services
The Services are intended for adults. You must be at least 18 years old to independently register, purchase, or participate. A minor may participate only when Diabetes Insight expressly permits it and a parent or legal guardian completes all required registration, consent, and payment steps.
3.2 Accurate Information
You agree to provide accurate, current, and complete registration, contact, payment, and health-related information and to update it when necessary. We may decline or cancel registration if information is materially inaccurate, incomplete, fraudulent, or insufficient to administer the Service safely and appropriately.
3.3 Referrals and Records
Certain Services may involve information or records received from a physician, clinic, hospital, caregiver, or other referral source. Our handling of personal and health information is described in the Website Privacy Policy and Health Information Privacy Notice.
4. Scheduling and Participation
4.1 Appointment and Class Availability
Registration is subject to availability and is not complete until confirmed through our scheduling system or by Diabetes Insight. Start times, instructors, locations, delivery methods, and class formats may be changed when reasonably necessary.
4.2 Timely Participation
You are responsible for joining or arriving on time and following reasonable participation instructions. Late arrival may shorten an individual session or prevent entry into a group class when admission would disrupt the program or compromise another participant’s privacy.
4.3 Appropriate Conduct
Participants must communicate respectfully, follow instructor directions, protect the privacy of other participants, and refrain from harassment, threats, discrimination, disruption, recording without permission, unlawful activity, or misuse of the Services. We may remove a participant or end participation when reasonably necessary to protect safety, privacy, program integrity, or other participants.
4.4 Accessibility and Accommodations
Contact us before the scheduled Service if you need a reasonable accommodation. We will make reasonable efforts to address requests but cannot guarantee that every requested accommodation or delivery method will be available.
5. Prices, Payments, and Taxes
5.1 Prices
The price displayed at the time of booking applies to the selected Service unless an obvious pricing error occurred. Prices are stated in U.S. dollars and may change for future bookings.
5.2 Payment
Payment is due as stated during booking. Payments may be processed through a third-party payment provider. You authorize the applicable charge and represent that you are authorized to use the payment method provided. We do not guarantee acceptance of every payment method.
5.3 Self-Pay Services
Diabetes Insight currently offers Services on a self-pay basis. Unless we expressly agree otherwise in writing, you are responsible for the full cost. We do not promise that a health plan, employer, or other third party will reimburse you.
5.4 Taxes and Fees
You are responsible for applicable taxes or charges disclosed during checkout. Your bank, card issuer, telecommunications provider, or other third party may impose separate fees that are not controlled by Diabetes Insight.
6. Cancellations, Rescheduling, and Refunds
6.1 Booking-Specific Policy
The cancellation, rescheduling, no-show, and refund policy displayed during booking or provided in the confirmation for a particular Service applies to that booking. Review it before completing payment. If no separate policy is displayed, contact Diabetes Insight as soon as possible to request a cancellation or rescheduling.
6.2 Participant Cancellations and No-Shows
Requests are subject to instructor and class availability. Failure to attend, late cancellation, or late arrival may result in loss of some or all fees when disclosed by the applicable booking policy, except where a refund or other remedy is required by law.
6.3 Diabetes Insight Cancellations
We may cancel or reschedule a Service because of instructor unavailability, insufficient enrollment, technical problems, unsafe conditions, emergencies, or other reasonable circumstances. When we cancel and cannot provide a reasonable replacement, we will provide a refund of the amount paid for the affected Service.
7. Virtual Services and Technology
7.1 Participant Requirements
For virtual Services, you are responsible for a compatible device, internet access, software, audio and video equipment where required, and a reasonably private environment. Standard internet, mobile, and data charges may apply.
7.2 Technical Problems
Technology may fail or become unavailable. We will make reasonable efforts to address technical problems within our control but are not responsible for outages, device failures, connectivity issues, or third-party platform failures outside our reasonable control. We may reschedule when a material problem prevents delivery of the Service.
7.3 No Recording
You may not record, photograph, screenshot, broadcast, copy, or redistribute a class, session, participant, instructor, screen, or educational material without prior written permission from Diabetes Insight and any other person whose permission is legally required.
8. Group-Class Privacy
Group Services may involve questions or voluntary sharing by participants. You agree not to disclose another participant’s identity, health information, statements, images, or circumstances outside the group. Although Diabetes Insight establishes reasonable expectations for participant conduct, we cannot guarantee that another participant will comply. Share only information you are comfortable discussing in a group setting.
9. Privacy and Electronic Communications
Our Website Privacy Policy and Health Information Privacy Notice describe how we handle personal and health information and are incorporated by reference where applicable. We may communicate about appointments and Services through CharmHealth, email, text message, telephone, voicemail, or another method you provide or authorize. Electronic communications may carry privacy risks. Tell us if you reasonably need an alternative communication method.
10. Third-Party Platforms and Services
The Services may use or link to third-party platforms, including CharmHealth, payment processors, video-conferencing providers, mapping services, or social-media services. Third parties may apply their own terms and privacy notices. Diabetes Insight is not responsible for an independent third party’s content, availability, security, or practices, except to the extent responsibility cannot lawfully be excluded or the third party acts on our behalf under an applicable agreement.
11. Intellectual Property
11.1 Ownership
The website, curriculum, class content, handouts, videos, text, graphics, trademarks, logos, downloads, and other materials provided by Diabetes Insight are owned by or licensed to Diabetes Insight and are protected by intellectual-property laws.
11.2 Limited Personal Use
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use materials provided to you for your personal, noncommercial educational use. No ownership right is transferred.
11.3 Prohibited Uses
Without prior written permission, you may not reproduce, publish, sell, license, modify, create derivative works from, publicly display, teach from, upload, distribute, scrape, or commercially exploit our materials or use our trademarks, logos, or branding.
12. Acceptable Website Use
You may use the website only for lawful purposes. You may not attempt unauthorized access; interfere with security or operation; introduce malware; impersonate another person; submit fraudulent information; scrape or harvest information; violate intellectual-property or privacy rights; or use the website in a manner that harms Diabetes Insight, its users, or another person.
13. Disclaimers
To the fullest extent permitted by law, the website, general website content, and Services are provided on an "as available" basis. We do not warrant uninterrupted or error-free operation, universal suitability, or a particular educational or health result. Nothing in these Terms excludes a warranty, duty, or remedy that cannot legally be excluded. These disclaimers do not excuse Diabetes Insight from responsibility imposed by applicable professional, privacy, consumer-protection, or other law.
14. Limitation of Liability
To the fullest extent permitted by law, Diabetes Insight and its owners, employees, instructors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or Services. To the extent a monetary limitation is legally permitted, our aggregate liability arising from a paid Service will not exceed the amount you paid Diabetes Insight for the Service giving rise to the claim.
These limitations do not apply to liability that cannot be limited under applicable law, and they do not waive any nonwaivable rights or remedies.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold Diabetes Insight harmless from third-party claims, damages, and reasonable costs arising from your unlawful conduct, infringement of another person’s rights, unauthorized recording or distribution, misuse of the Services, or material violation of these Terms. This provision does not require you to indemnify Diabetes Insight for its own negligence, professional misconduct, or violation of law.
16. Suspension or Termination
We may suspend or terminate access to the website or Services when reasonably necessary because of nonpayment, fraud, unlawful conduct, safety concerns, harassment, material disruption, privacy violations, or material breach of these Terms. When practicable, we will provide notice. Any refund will be determined under the applicable booking policy and law.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Unless applicable law requires otherwise, legal proceedings relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Duval County, Florida. Nothing in this section prevents either party from pursuing relief in small-claims court when eligible.
18. Changes to These Terms
We may update these Terms to reflect changes in our Services, practices, technology, or legal obligations. The revised Terms will be posted with a new effective date. Changes apply prospectively unless applicable law permits otherwise. Terms accepted for a completed purchase will continue to govern that purchase unless the parties agree otherwise or law requires a change.
19. General Provisions
If any provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent. Headings are for convenience and do not alter meaning. These Terms, together with incorporated policies and booking-specific terms, constitute the agreement concerning the website and Services covered by them.
